DECISION OF THE BOARD; April 9, 2001
1This is an application for termination of bargaining rights under section 63 or 132 of the Act, construction industry. The Baord received the applicant’s Form A-77 on March 20, 2001.
2The Board’s Rules of Procedure require an applicant to deliver the application to the union and the employer not later than two days after the application is filed with the Board. The delivery of application must be verified by filing a Certificate of Delivery (Form A-81) with the Board not later than two days after the application is filed with the Board.
3The Board notes counsel for the responding party takes the position that this application is deficient because if dos not comply with the Board’s Rules of Procedure.
4No Certificate of Delivery (Form A-81) was filed with the Board as required by the Board’s Rules. The Board is unable to process this application without a Certificate of Delivery verifying when the correct documents were delivered to the union and the employer pursuant to the Board’s Rules of Procedure.
5If no Certificate of Delivery (Form A-81) is received within five (5) days, this matter will be deemed to be terminated without further notice to any of the parties.
