1This is an application pursuant to the Employment Standards Act for review of an Order to Pay (No. 58607) made by an Employment Standards Officer.
2The matter was scheduled to be heard on August 22, 2001, at 9:30 a.m.
3The applicant failed to appear at the hearing by 10:00 a.m., although duly notified of the hearing by the Registrar. The applicant has the burden of proof. Accordingly, in the absence of any evidence from the applicant, the Board has decided to dismiss the application.
4The application is dismissed.
5The Board directs the Director of Employment Standards to pay out the money held in trust as follows:
To the claimant, Sue Barns $4,915.21
To the Government of Ontario $ 491.52
Consolidated Revenue Fund
Interest on the above amounts which are held in trust
shall be paid to the recipients pro rata.
