DECISION OF THE BOARD; June 25, 2001
1This is an application pursuant to section 68 of the Employment Standards Act, and employer appeal against Order to Pay 57387 of June 22, 2000. The order related to nine employees. Minutes of Settlement have been concluded between the employer and the individual employees. Having regard to the Minutes of Settlement, I hereby order:
(i) that the wages paid to the "Director in trust" in relation to this matter be disbursed as follows:
to be paid to the Employer $ 12,841.92
to be paid to Maria Tatangelo $ 2,533.44
to be paid to Raffaella Mandarino $ 2,125.76
to be paid to Shakil Ahmed $ 3,640.00
to be paid to Maria Melissa $ 2,912.00
to be paid to Guido Troncone $ 5,503.68
to be paid to Maria Vargas $ 2,912.00
to be paid to Gianfranco De Re $ 3,727.36
to be paid to Antonio Batek $ 6,406.40
to be paid to Concetta Rigatti $ 203.84
(ii) that the administration fee as set
out in the Order to Pay be retained
by the Government of Ontario
Consolidated Revenue Fund $ 4,280.64
total amount held by the Director $ 47,087.04
2The Ministry of Labour, a responding party to the application but not a signatory to the Minutes of Settlement, shall have ten working days from the date of this decision to request, if necessary, that this matter be relisted for hearing.
DISPOSITION
3In the absence of a request described in paragraph 2, this matter shall be deemed to be terminated.
