DECISION OF THE BOARD; December 19, 2001
1This is an application under section 96 of the Labour Relations Act, 1995 (“the Act”), in which the applicant alleges that the responding party trade union contravened section 74 of the Act when it failed to proceed to arbitration with a grievance respecting the intervenor’s termination of the applicant’s employment.
2This matter came before the Board for consultation on December 19, 2001.
3At the conclusion of the consultation, on consent of the parties, the Board reserved on its decision until at least January 15, 2002, to enable the applicant to advise the Board and the other parties in writing if he wishes to have the Board proceed to issue its decision, or if he wishes to withdraw his application. If the applicant fails to advise the Board of his intentions by January 15, 2002, the Board will assume that he wishes to have the matter determined, and will proceed to issue its decision thereafter.
