DECISION OF THE BOARD; July 11, 2001
1This is an application for the referral of a grievance to arbitration pursuant to section 133 of the Labour Relations Act, 1995, S. O. 1995 ch. 1 (the "Act"). The responding party has asked for particulars of the amounts claimed. In the Board's view, based on the material currently in the file, the grievance is sufficiently particularized. Some matters will inevitably be within the exclusive knowledge of the responding party, and it appears that the applicant has served or attempted to serve a summons on the person who will be able to provide the necessary evidence to quantify any claim. Since this person is an officer of the responding party, it would not appear to present any considerable prejudice to the responding party.
2The hearing will proceed on July 12, 2001.
