DECISION OF THE BOARD; August 27, 2001
Mr. DeFazio’s representative has advised the Board that he has recently come into possession of fresh evidence with respect to this matter. He requests that he be permitted to lead the evidence despite the fact that we are now into final argument.
Before the Board seeks the position of the responding party, it requires the following information from the applicant:
a) the nature of the evidence;
b) its relevance to the proceeding;
c) the date on which it was obtained and how; and
d) why it could not have been obtained earlier with reasonable diligence.
- The required information must be delivered to the responding party and filed with the Board by no later than August 31, 2001.
