DECISION OF THE BOARD; June 25, 2001
The applicant seeks production from the responding party of a copy of any notes authored by Leo Levesque, an employee of the company, which the responding party has in its possession. The responding party contends that the notes are not relevant, and belong to a witness under subpoena served by the applicant.
Without making any determination at this stage concerning the relevance or the admissibility of the notes in this matter, the Board directs the responding party to provide to the applicant a copy of whatever copies of Mr. Levesque’s notes (pertaining to the issues in this matter) the responding party has within its possession, and to do so on or before June 29, 2001.
To the extent either party wishes to tender the notes in evidence, and there is any objection, I shall deal with the objection in the course of the hearing.
