DECISION OF THE BOARD
This is in respect of an application that was dismissed by the Board on April 6, 2001.
The Board is in receipt of a letter dated June 25, 2001 from counsel for the responding party, Borden Cold Storage Limited. The letter requests that the Board consider making an order for payment of “costs” by the applicant union in favour of the responding party, and asks whether the Board would be prepared to entertain argument on the issue. It is not clear whether this letter was copied to the other parties.
Having issued a final decision, I decline at this juncture to entertain argument on the issue of costs, and there is therefore no need to seek the parties’ submissions as to the appropriateness or the merits of making such an order. However, even if this were not the case, it should be noted that the Board has decided in the past that it does not have jurisdiction to award costs. See, for example, Bellai Brothers Ltd., [1994] OLRB Rep. January 2.
