DECISION OF THE BOARD; December 24, 2001
This is an application under sections 69 and 1(4) of the Labour Relations Act, 1995, S.O. 1995, c. 1, as amended ("the Act").
Pursuant to the Board’s decision of November 29, 2001, the following bargaining unit constitutes a unit of employees of the responding party which is appropriate for collective bargaining:
all employees of the County of Huron employed as paramedics/ambulance attendants, save and except supervisors and persons above the rank of supervisor,
constitute a unit of employees of the responding party appropriate for collective bargaining.
On the taking of the representation vote directed by the Board, more than fifty per cent of the ballots by employees in the bargaining unit were cast in favour of the Canadian Union of Public Employees, Local 4175.
The Canadian Union of Public Employees, Local 4175 is declared to be the bargaining agent of the employees in the bargaining unit.
The Registrar will destroy the ballots cast in the representation vote taken in this matter following the expiration of 30 days from the date of this decision unless a statement requesting that the ballots should not be destroyed is received by the Board from one of the parties before the expiration of such 30 day period.
The representation vote was taken on the basis of Minutes of Settlement concluded between the parties. The Board has received a letter dated December 20, 2001 from James A. Renaud in which he contends that the County of Huron has breached the Minutes of Settlement. He asks that a Labour Relations Officer be assigned to meet with the parties to address the issue.
The matter is referred to the Registrar to appoint a Labour Relations Officer to meet with the parties to deal with the issue raised by Mr. Renaud.
