DECISION OF THE BOARD; December 11, 2001
1This is an application under the Public Sector Labour Relations Transition Act, 1997 (“the Act”).
2The dispute between the Ottawa Public Library Board and CUPE, Local 503 concerning the bargaining unit description which will apply to Local 503’s bargaining unit in the Ottawa Public Library has been resolved.
3Accordingly, under the provisions of the Act, the Board declares Local 503 to be the bargaining agent of the following bargaining unit:
all employees of the Ottawa Public Library Board save and except Managers and those persons above the rank of Manager, Planning Officers, three (3) administrative assistants to the City Librarian and one (1) Administrative Assistant per Division Manager, and any other persons excluded under the provisions of the Ontario Labour Relations Act, 1995.
Clarity Note: The parties agree that the position of “Manager” as set out in this scope clause includes the positions set out in the attached list of “Manager” (Appendix “A”).
With respect to the creation of any new position of “Manager”, the Parties agree that a position that meets the following criteria shall be excluded from the bargaining unit.
a) a Manager of any new library branch or branches; and/or
b) a person excluded from the bargaining unit under the provisions of the Ontario Labour Relations Act, 1995.
The Parties also agree that the inclusion or exclusion of volunteers, summer students and co-op students in the bargaining unit shall be discussed during negotiations.
