Decision
1This is an appeal of the order of Inspector Bob Wright .pursuant to section 61 of the Occupational Health and Safety Act (the “Act”) set out in F.V. No. 860495 dated December 16, 1999. The appeal was filed with the Board on January 13, 2000 and is therefore timely.
2By letter dated June 1, 2001, counsel for the Ministry of Labour and the Inspector advised that the order under appeal has been rescinded and takes the position that this appeal is now moot. The Board notes a copy of the Ministry’s letter was sent to the other parties. This matter is scheduled for hearing on June 20, 2001. Counsel for the responding party request the Board consider this issue before the hearing.
3The Board hereby directs the applicant to advise the Board and the other parties, within seven days of the date of this decision, as to what position the applicant takes with respect to this issue.
4This panel of the Board is not seized with this matter.
