DECISION OF THE BOARD; December 21, 2001
1The Board has received the letter from counsel to the applicant in Board File No. 1085-00-R. Although there has been some hearing time devoted to the other two files, it may be possible to combine the applications at the present time. I am concerned, for instance, about the production of a huge number of documents that will take place in the week of January 7, 2002, as well as the expenditure of the Board’s time in hearing similar evidence in two cases. However, the responding parties may see some prejudice to them. In addition, if the applicants in Board File No. 1085-00-R seek consolidation, they will take the dates for hearing and document production as they find them.
2Accordingly I propose to hold a conference call with all four counsel. I am in the office for administrative decisions for the entire week of December 31, 2001 to January 4, 2002. I would propose to hold the conference call on January 2, 2002 at 5:00 p.m., but it can be done at any time during the week. I direct all four counsel to consult with one another and advise if there is another time which is more appropriate. The holidays may present some problems, but I would like to hear from at least one counsel by no later than 12:00 noon on December 31, 2001.
