DECISION OF THE BOARD; November 15, 2001
1The style of cause is hereby amended to reflect the correct name of the responding party: "Prosperi Plastering Company Ltd.".
2The Board has reviewed the submissions filed by the parties. The applicant submits that the ballots of the five individuals it submits are in the unit ought to be counted as, if the applicant does not have the support of a majority of such individuals, the applicant concedes that the application ought to be dismissed. The responding party and intervenor do not agree to the counting of the five ballots.
3Neither the responding party nor the intervenor have referred to any prejudice that would result if the five ballots were to be counted. There is a potential for the counting of the ballots to result in this matter being determined absent litigation.
4Accordingly, the Board hereby orders that the ballots cast by Jamie Dashnay, Steve Lacasse, Guy Pasara, Nick Pasara and Louis Rivet be counted. This matter is referred to the Manager of Field Services for the appointment of a Labour Relations Officer who will arrange for the counting of the ballots.
