Decision of the Board
1This is a reference from the Minister of Labour (“the Minister”) pursuant to section 3(2) of the Hospital Labour Disputes Arbitration Act, R.S.O. 1990 c. H.14 (“the Act”).
2The question referred by the Minister to the Board for its advice is: “Is the Employer a “hospital” within the meaning of the Hospital Labour Disputes Arbitration Act?”
3The Board is in receipt of correspondence dated November 28, 2001 from the representative of Ontario Nurses’ Association advising that the parties have settled a collective agreement, and requesting the Board to report to the Minister that the Board will not deal further with the reference as there is no longer a question on which to report the Board’s advice.
4The Board has not been informed by the Minister or his duly appointed designate that the Board should not consider the question set out in paragraph 2 above.
5The parties may wish to consider requesting the Minister to withdraw the reference. If the Minister or his duly appointed designate does so, the Board will not consider the matter further.
