Ontario Labour Relations Board
2120-01-U Margaret Lucas, R.P.N., Applicant v. Service Employees International Union Local 220, Responding Party.
BEFORE: Stephen Raymond, Vice-Chair.
DECISION OF THE BOARD; November 22, 2001
This application is an allegation that the trade union has unfairly represented the applicant. The trade union requests that the Board dismiss the application prior to filing its response.
The trade union takes the position that the events that gave rise to the complaint had occurred by April 2000. The application was completed on October 25, 2001.
The applicant is directed to confirm by December 12, 2001 the latest date upon which the events occurred that give rise to the complaint and provide any explanation that there may be for the delay in filing the application.
Once the Board is in receipt of that information, it will proceed to address the preliminary motion of the trade union that this application should be dismissed. If the applicant fails to comply with this directive, the application will be dismissed.
I am seized of this application.
“Stephen Raymond”
for the Board
