DECISION OF THE BOARD; July 13, 2001
This is an employee application for review of the refusal of an Employment Standards Officer to issue an Order to Pay against an employer.
The employer served Carol Blake, the spouse of the applicant, with a summons to witness. That summons required Ms. Blake to bring certain documents to the hearing of this matter.
The hearing in this matter was originally set for April 23, 2001. The parties agreed to adjourn the hearing but asked the Board to rule on the document production issue, as Ms. Blake appeared to object to producing certain documents.
By decision dated April 23, 2001 the Board directed Ms. Blake to file submissions if she objected to the production of the documents listed on her summons to witness. Ms. Blake has not filed any submissions with the Board.
Accordingly, the Board orders Ms. Blake to deliver, within 15 business days of the date of this decision, to counsel for the employer all of the documents listed in Schedule “A” to her summons to witness dated March 14, 2001.
