DECISION OF THE BOARD; May 9, 2001
1. This is an application for a determination of bargaining units and bargaining agents arising out of reorganization of municipal hydro electric commissions, pursuant to the Public Sector Labour Relations Transition Act, 1997 (the “Act”).
2. The parties reached agreement on the description of the bargaining unit as follows:
all employees of Haldimand County Hydro Inc. in or out of Haldimand County, save and except managers and persons above the rank of manager, Customer Service Supervisor, Line Supervisor, Accountant, Executive Assistant and temporary special work employees.
Clarity Note #1: “Lines Supervisor” is a non-working supervisory position.
Clarity Note #2: “Temporary Special Work Project” refers to a special work project of less than 3 months duration.
3. The Board ordered a representation vote to determine which of the bargaining agents would represent the employees. On the taking of the representation vote, a majority of votes were cast in favour of the International Brotherhood of Electrical Workers, Local 636. The Board declares the International Brotherhood of Electrical Workers, Local 636 to be the bargaining agent in respect of the bargaining unit set out above. Accordingly, under section 23(9) of the Public Sector Labour Relations Transition Act, 1997, any bargaining rights held by the Power Workers’ Union CUPE Local 1000 – C.L.C. and by the United Food and Commercial Workers’ International Union, Local 175 are hereby terminated.
4. The Board directs the employer to post this decision alongside the Board’s earlier postings.
5. The Registrar will destroy the ballots cast in the representation vote following the expiry of 30 days from date of this decision unless one of the parties requests in writing before that date, that the ballots not be destroyed.
