1Board File No. 0990-01-G is an application for the referral of a grievance to arbitration pursuant to section 133 of the Labour Relations Act, 1995, S.O. 1995 ch. 1 (the "Act") which was filed by the United Brotherhood of Carpenters and Joiners of America, Local 397 (the "Carpenters") against the responding party, Canbuild Management Services Limited. Board File No. 2142-01-R is an application under section 69 and 1(4) of the Act filed by the Carpenters in respect of the responding parties, Canbuild Management Services Limited, Curmac Enterprises Inc., Curmac Enterprises Inc. c.o.b. Canbuild Management Services, 1061921 Ontario Inc., 1061921 Ontario Inc. c.o.b. Canbuild Management Services and Podium Consulting Inc.
2By correspondence dated October 30, 2001, counsel for the Carpenters notes that the applications in these Board files are related. He asks that the Board proceed with the referral of grievance to arbitration and schedule it to be heard together with the application in Board File No. 2142-01-R. The applicant also requests that the following employers be added as responding parties in OLRB File No. 0990-01-G: Curmac Enterprises Inc., Curmac Enterprises Inc. c.o.b. Canbuild Management Services, 1061921 Ontario Inc., 1061921 Ontario Inc. c.o.b. Canbuild Management Services and Podium Consulting Inc. The applicant did not, however, file an amended Certificate of Delivery certifying that the application in Board File No. 0990-01-G and other required documents have been delivered to these additional employers.
3In the circumstances, the Board directs the Registrar to list the application in Board File No. 0990-01-R and 2142-01-R for hearing together. The Board also considers it appropriate to defer consideration of the applicant's request to add the additional employers listed above as responding parties in Board File No. 0990-01-G until after the Board has considered the application in Board File 2142-01-R.
