DECISION OF THE BOARD; May 18, 2001
Decision
1Board File No. 3888-00-R is an application for certification.
2Board File No. 0170-01-U is an application under section 96 of the Labour Relations Act, 1995 (the “Act”).
3Board File No. 0180-01-R is an application under section 69/1(4) of the Act.
4By letter dated May 11, 2001, counsel to Canadian National Federation of Independent Unions, Local 3000 has suggested that the Board should dismiss the application in Board File No. 0170-01-U for failing to make out a prima facie case of a breach of the Act.
5Having reviewed the allegations raised in that application, the Board is not persuaded that the application in Board File No. 0170-01-U should be dismissed without a hearing for failing to make out an arguable case of a breach of the Act.
6These applications are referred to the Registrar to be scheduled for hearing in the normal course.
