DECISION OF THE BOARD; November 13, 2001
Decision
1The Board is in receipt of correspondence dated November 1, 2001 (received by the Board on November 5, 2001) from Robert Pritchard on behalf of ten other former Smith Falls Water Commission employees, all of whom are alleged now to be employees of the responding party. Mr. Pritchard advises that he and the employees wish to retain their non-union status and do not wish to be represented by the applicant.
2On November 8, 2001 counsel for the responding party wrote to the Board, and submitted that the non-union employees be added as intervenors. Counsel for the applicant responded by letter dated November 9, 2001 opposing the submission of counsel for the responding party.
3Because the non-union employees appear to be employees of the responding party, this is an appropriate case to add these individuals as interested parties. Any further issues concerning their status or entitlement to participate in this matter may be referred to the panel of the Board assigned to the hearing of this matter.
4The Board directs that Tom Crawford, Graeme Dixon, Harris Dodd, Ron Hewitt, Fred Himmelman, Ted Joynt, Kevin Kelly, Steven Laplante, Glen McNamara, Robert Pritchard and Doug Walker are hereby added as interested parties.
5Having regard to the agreement of the applicant and the responding party the Board consents to the adjournment of the December 6, 2001 hearing date in this matter. This matter is hereby rescheduled to commence on December 19, 2001 at 9:30 a.m. in the "Board Room", 2nd Floor, 505 University Avenue, Toronto, Ontario.
