DECISION OF THE BOARD; July 5, 2001
These files consist of two applications seeking a declaration that there has been a sale of business and/or that the responding parties should be found to be a single employer pursuant to the Labour Relations Act, 1995 (the “Act”); an application seeking a termination of a collective agreement because it is not a valid voluntary recognition agreement, and a referral of a grievance in the construction industry.
Since all parties agree that the outcome of the referral of the grievance in the construction industry depends on the result of the other proceedings, it is appropriate to adjourn it. Consequently, Board File 2006-00-G is adjourned pending the outcome of the rest of these proceedings.
After a useful discussion with counsel about the appropriate method of proceeding, the parties agreed that the Board would first hear and decide Board File 3189-00-R, which is the challenge to the collective agreement entered into between the Communications, Energy and Paperworkers Union of Canada, Local 672 and Markson Construction Services Inc.
This matter will continue on September 20 and 21, 2001, commencing at 9:30 a.m. each day at the Four Points Sheraton Hotel, 1150 Wellington Road South, London, Ontario.
