DECISION OF THE BOARD; August 2, 2001
1This is an application for a review of a decision of an Employment Standards Officer pursuant to section 68 of the Employment Standards Act, R.S.O. 1990 ch. E-14 ("the Act"). The Board is satisfied that the reasons set out in the applicant's letter of July 27, 2001 are sufficient to justify an extension of time limits for the filing of the application. The amount of time required for the extension is very short and the delay was caused only by the applicant's failure to read the information with respect to the proper address for service on the Order to Pay (although that document itself contains an error which did not mislead the applicant).
2The applicant should be advised that Employment Standards officers are not officers of the Board in any sense. The Board is an independent quasi-judicial tribunal which deals with the applications and parties who appear before it. The Ministry will be a party in the same sense that the applicant is, and has no different status than any other party to the proceeding.
3The time for filing this application is extended to July 23, 2001, the date on which all documents and monies were delivered to the proper offices. The Registrar is directed to process this application in the usual manner.
