Decision of the Board
1Further to the Board’s decision of October 15, 2001, the Board is in receipt of correspondence from Tooral Kandhai and Michael Duncan indicating that they no longer wish to pursue their claim as they have filed a grievance concerning their termination and termination pay with the union.
2Having regard to the October 10, 2001 correspondence from the Ministry of Labour in which the Ministry submits that the Board should set aside the Order to Pay and require the funds posted by the employer be returned to the employer, the Board hereby makes the following orders and directions.
3The Board hereby declares that Order to Pay No. 57321 issued in connection with Employment Practices Branch File No. 32007724, is set aside. The Board directs that the full amount of the wages paid by the applicant, namely $16,255.03, to the “Director in Trust” in relation to this matter be paid out to Paragon Protection Ltd.
