This is an application under section 96 of the Labour Relations Act, 1995, S.O. 1995, c. 1, as amended (the "Act") which alleges a breach of section 75 of the Act.
BACU, Local 1 requests that the Board dismiss the application without a hearing for failure to plead a prima facie breach of the Act. The applicant has filed submissions in response to that request.
The Board has carefully reviewed the submissions filed. Under all of the circumstances, the Board finds it appropriate that this matter proceed to a consultation.
The matter is referred to the Registrar.
