DECISION OF THE BOARD; July 23, 2001
1This is a referral of a grievance to the Board for determination under section 133 of the Labour Relations Act, 1995, S.O. 1995, c.1 as amended ("the Act").
2Prior to the hearing in this matter the parties entered into the following Memorandum of Agreement:

United Brotherhood of Carpenters and Joiners of
America Local 2486,
The Applicant,
‑ and ‑
Belanger Construction Limited,
The Responding Party.
Memorandum of Agreement
Whereas the applicant file [sic] a grievance alleging that the Responding Party violated the terms of their collective agreement;
And Whereas the parties are in agreement to resolve this complaint without a hearing;
Therefore the parties agree to the following as full and final settlement of all issue in dispute:
(1) The Responding Party agrees that the collective agreement was violated.
(2) The Responding Party agrees to cease and desist from violating the collective agreement.
(3) The Responding Party further agrees to compensate Michel Gauvin for thirty-two (32) hours in wages within fourteen (14) days of the execution of these Minutes of Settlement.
(4) The Parties agree that the payment made in the above will be subjected to all legal and statutory deductions.
