DECISION OF THE BOARD; September 6, 2001
1This is a request for reconsideration of my decision of July 13, 2001 in which I dismissed the applicant’s application for review under the Employment Standards Act, R.S.O. 1990, c.E-14, as amended.
2The request for reconsideration was filed with the Board on August 24, 2001. Rule 96 of the Board’s Rules of Procedure provides:
- No request for reconsideration will be considered where it is filed more than twenty (20) days after the date of the Board's decision, except with the permission of the Board.
3The applicant did not request an extension for the filing of the reconsideration request, nor did he explain the late filing. For those reasons alone, I decline to consider the request for reconsideration.
4Even had the request for reconsideration been filed in a timely manner, I would have declined to reconsider my decision of July 13, 2001. That is because the applicant provided no compelling reasons of the kind the Board traditionally has taken into account in determining whether to reconsider its decisions. The applicant merely disagrees with my conclusion that he was not constructively dismissed. That is not sufficient.
5I decline to reconsider my decision of July 13, 2001.
