DECISION OF THE BOARD; June 27, 2001
[1]. This is an application under sections 21, 21 and/or 23 of the Public Sector Labour Relations Transition Act. The Service Employees Union Local 210 (referred to as the “SEU”) has filed a response in which it states as follows:
SEIU Local 210 disputes this application in its entirety. SEIU position is that the circumstances do not give rise to the relief applied for and, thus, there should be no order changing any of the Bargaining Units involved nor should any vote be ordered. Instead, this Application should be dismissed without need for a consultation hearing or other hearings before the Board.
[2]. The SEU has not referred to any facts or provided any reason in support of its claim that the “circumstances do not give rise to the relief applied for”. The Board therefore denies its request to dismiss this application without a consultation. This application will therefore proceed in the normal course.
