Ontario Labour Relations Board
1437-01-R Labourers’ International Union of North America, Applicant v. Colangelo Carpentry Co. Ltd. and 800965 Ontario Limited, c.o.b. as Colangelo Carpentry and J.C. Carpentry Limited, Responding Parties v. Carpenters & Allied Workers Local 27, United Brotherhood of Carpenters and Joiners of America, Intervenor.
BEFORE: Laura Trachuk, Vice-Chair.
DECISION OF THE BOARD; October 18, 2001
1This is an application for certification in the construction industry. Subsequent to the Board’s decision of August 21, 2001 ordering a representation vote, the Carpenters and Allied Workers Local 27 have intervened. The intervenor takes the position that it already represents the employees in the bargaining unit applied for by the applicant. It claims that the application is therefore untimely.
2The Board will proceed to determine that matter first at the hearing scheduled for this application. If the Board finds that the application is timely it will determine the question of whether the intervenor may continue to participate in the litigation of the status disputes.
3This matter is being referred to the Registrar to set a hearing date.
