1. This is an application for review of a refusal by an Employment Standards Officer
to make an order to pay, pursuant to the Employment Standards Act.
2. The matter was scheduled to be heard in the Credit Room at the Cleary International Centre in Windsor, Ontario on October 23, 2001 at 9:30 a.m. The applicant and the responding party employer failed to appear by 10:00 a.m.
3. There is no information before the Board to indicate that these parties did not receive the Notice of Hearing sent by the Registrar, dated September 17, 2001.
4. The applicant has the onus of producing evidence in support of his application.
5. Having no evidence adduced in support of the application, the Board dismissed the application by oral ruling on October 23, 2001.
6. The application is dismissed.
