DECISION OF THE BOARD; October 25, 2001
1The Board has not considered these four files together before this time. Until one or more of them is set for hearing, the Board will deal with these files as a group. Until a hearing date is set, I am seized of all of them, for procedural matters only. In Board File No. 0119-01-R, of course, a panel of myself and Board Members J.G. Knight and G. McMenemy are seized of the request for reconsideration.
2The hearing set in File No. 1740-01-R for October 29 and 30, 2001 is cancelled. It is evident that the application in Board File No. 1739-01-R cannot proceed until the Board disposes of the application for reconsideration in Board File No. 0119-01-R. Board File No. 1740-01-R is integrally related to that application, and indeed appears to be simply an application in the alternative. None of these matters can be dealt with in any coherent way until the application for reconsideration in Board File No. 0119-01-R is disposed of.
3The parties are directed to file their submissions as set out in the decision of October 16, 2001 in Board File No. 0119-01-R. Following receipt of those submissions, the Board will determine what is to be done in all of these files.
