MINUTES OF SELLEMENT AND REQUEST FOR CONSENT ORDER
WHEREAS hearings in respect of the above matters have commenced before the Ontario Labour Relations Board (“the Board”) and further hearings are scheduled on September 19 and 20, 2001 and following;
AND WHEREAS the parties have agreed to resolve all outstanding matters between them;
NOW THEREFORE the parties agree, each with the others, to request that the Board make the following orders to be effective forthwith unless otherwise indicated:
An order in O.L.R.B. File Nos. 1320-99-R and 1332-99-G dismissing the application for a declaration that Mega City Tiling and Maran Ceramic Tiles Inc. constitute one employer within the meaning of Section 1(4) of the Labour Relations Act
An order in O.L.R.B. File Nos. 1320-99-R and 1332-99-G dismissing the application that Mega City Tiling is a successor to Maran Ceramic Tiles Inc. within the meaning of Section 69 of the Act.
A declaration that Maran Ceramic Tiles Inc. is bound to the Bricklayers Provincial Collective Agreement between the Bricklayers Employer and Employee Bargaining Agencies.
An order granting the applicant leave to withdraw the referral grievance to arbitration forming this subject matter of O.L.R.B. File No. 1332-99-G.

Also pursuant to the above noted agreement Board File No. 1320-99-R is dismissed and Board File No. 1332-99-G is withdrawn.
