DECISION OF THE BOARD
This matter is a referral of grievance to arbitration pursuant to section 133 of the Labour Relations Act, 1995 that has been listed for hearing on June 26, 2001.
The applicant has, by way of letter dated May 24, 2001 copied to counsel for the responding party, requested that the Board order pre-hearing production of the documents described therein.
This is a grievance in which the applicant alleges that the employer has failed to pay the appropriate wages, overtime, travel and other monetary benefits and to file correctly completed employer contribution reports as required by the terms of the collective agreement. The documents sought are documents that would assist the applicant in calculating the hours worked by the bargaining unit members and hence the amount of money owing. The documents are thus arguably relevant to the issues in dispute.
The responding party is hereby directed to either provide copies of the documents sought by the applicant as described in its letter of May 24, 2001 to counsel for the applicant or make such documents available for the applicant’s review and copying, no later than 5:00 on June 13, 2001.
