Decision
1This is an application for certification made pursuant to the construction industry provisions of the Labour Relations Act, 1995, S.O. 1995 ch. 1 (the "Act"). A representation vote has been held and the parties have gone through the process of meeting with a Board Officer in the Regional Certification Meetings to identify the issues.
2It appears that the parties are in agreement with respect to the name of the responding party. Accordingly, the style of cause is amended to identify Jirehtec Canada Inc. operating as JCI Development Group.
3The only other issue is the identity of the true employer of the five persons who cast ballots. The responding party takes the position that it has no relationship with those individuals. In accordance with the Board’s practice, it will be the responsibility of the applicant to produce those individuals for examination. It does appear that there may be documents in the possession of third parties which the applicant may wish to see.
4The applicant is directed to advise the Board how it wishes to proceed with this application on or before May 18th, 2001. I am seized of this application for the purposes of determining the scheduling of hearings and any procedural issues arising therefrom.
