DECISION OF THE BOARD; December 14, 2001
These are two applications. One is filed under section 69 and 1(4) of the Labour Relations Act, 1995 (the "Act") and the other is a referral of a grievance to arbitration under section 133 of the Act. The matters are scheduled for hearing on January 2 and 3, 2002.
By letter dated December 12, 2001 counsel for the applicant requests an order for production of documents and particulars from one of the responding parties, Urtech Electric Inc. Counsel advises that he has previously made this request of the responding party.
Urtech Electric Inc shall have two (2) days from the date of this decision to make any objections or submissions it may have with respect to the production request following which the Board will deal with the request.
In its letter the applicant also refers to an earlier request to deem Urtech Electric Inc. to have accepted all the facts pleaded in these applications as it has failed to respond. That matter has been addressed by the Board (differently constituted) in its decision of December 13, 2001.
