DECISION OF THE BOARD; October 2, 2001
1. This is an application for certification. In its response to the application the responding party indicates that it has no employees. It advises that the employees described in the applicant’s proposed bargaining unit are employed by Mister D Health Management & Consulting Inc. Mister D Health Management & Consulting Inc. has filed a “response” in which it also asserts that it employs the individuals in the bargaining unit. It also says that it has a voluntary recognition agreement and a recently ratified collective agreement with the Canadian Health Care Workers Union. The Board is treating the materials filed by Mister D Health Management & Consulting Inc. as an intervention at this time.
2. In these circumstances the Board considers it appropriate to seek submissions from the applicant before ordering the representation vote. The applicant is directed to file its submissions in response to the response and intervention by 5:00 p.m. Thursday October 4, 2001. It appears that the Canadian Health Care Workers may have an interest in this matter. The Board directs that that trade union be given notice of the application. If it wishes to file any materials with respect to this matter it should do so by 5:00 p.m. Thursday October 4, 2001.
3. After reviewing the submissions the Board will decide whether to proceed to hold a representation vote in this matter.
