DECISION OF THE BOARD; July 4, 2001
This is an application for certification in the construction industry. The applicant filed a previous application for certification with respect to the same bargaining unit of employees of the responding party on March 29, 2001. A representation vote was held with respect to that application. There are a number of outstanding issues in that application and no decision has been issued. The responding party and intervenor therefore object to the Board proceeding with this application. The Board considers it appropriate in these circumstances to direct the applicant to file submissions in response to the other parties’ objections prior to deciding whether a representation vote should be ordered. The applicant is therefore directed to file submissions in response to the request that the Board not proceed with this application by 5:00 p.m. Thursday, July 5, 2001.
