Decision
This is an application under section 63 of the Labour Relations Act, 1995 (the “Act”) in which the applicant seeks a declaration that the responding party no longer represents the employees in the bargaining unit for which it is the bargaining agent.
The responding party in its response states that it no longer wishes to represent the employees in the bargaining unit for which it is the bargaining agent.
In view of the responding party's position, and pursuant to section 63(17) of the Act, the Board hereby declares that the responding party no longer represents the employees of Muller Manufacturing Ltd., in the bargaining unit for which it is the bargaining agent.
The employer is directed to post copies of this decision immediately adjacent to all copies of the "Notice to Employees of Application for Termination of Bargaining Rights" posted previously. These copies must remain posted for 30 days.
