DECISION OF THE BOARD; July 5, 2001
[1]. This is an application under section 96 of the Labour Relations Act, 1995 (the “Act”).
[2]. In its response, the union has requested that the Board dismiss the application for failing to make out a prima facie case. In the alternative, the union notes that it has filed a grievance regarding the very subject matter which is the subject of the complaint and is proceeding with the grievance through the grievance procedure. The union therefore submits that the application is premature and should be dismissed on that basis in any event
[3]. The applicant is directed to file any submissions in response to these preliminary issues within five (5) days of the date of this decision.
