DECISION OF THE BOARD; September 26, 2001
1These are two applications; one filed under section 69/ 1(4) of the Labour Relations Act, 1995 (the “Act”) and the other a referral of a grievance to arbitration filed under section 133 of the Act.
2By letter dated September 13, 2001 counsel for the applicant requested the Board to order certain productions from the responding parties pursuant to sections 1(5) and 69(13) of the Act. The Registrar requested comments from the responding parties and did not receive any submissions.
3Having regard to these circumstances and the nature of these applications the responding parties are hereby ordered to produce the following to counsel for the applicant on or before 12:00 p.m. on Monday, October 1, 2001:
a) all documentation reflecting the share ownership, share holders, officers and directors of each of the responding parties;
b) all documentation reflecting assets and equipment owned by each of the responding parties either presently, or in the past;
c) all documentation reflecting all present and former clients of each of the responding parties;
d) all documentation reflecting all present and previous employees of each of the responding parties, including bargaining unit and non bargaining unit employees;
e) any and all documentation reflecting any relationship between the responding parties, whether of a business, legal, or other nature.
