DECISION OF THE BOARD; August 8, 2001
The applicant has referred a grievance concerning the interpretation, application, administration or alleged violation of a collective agreement to the Board for final and binding determination.
Prior to the hearing in this matter the parties entered into the following Memorandum of Agreement:
BETWEEN:
UNITED BROTHERHOOD OF CARPENTERS AND JOINERS OF AMERICA, LOCAL 2486,
("the Union")

GROUPE MULTI-PROV INC.,
("the Company")
MINUTES OF SETTLEMENT
WHEREAS the Union filed a grievance July 13, 2001
AND WHEREAS the parties wish to resolve the grievance as follows:
The Company agrees that it is bound to the Union’s Provincial Collective Agreement.
The Company agrees that it has violated the said Collective Agreement.
The Company agrees to pay to the Union the sum of $6000.00 as damages resulting from the violation of the Collective Agreement, such payment to be made within 8 days of execution of this Agreement.
Upon receipt of the payment referred to above, the Union agrees to withdraw the grievance.
The parties further agree that these minutes of settlement will be in a consent order of the Board.

- Having regard to the Minutes of Settlement, to the representations before it and pursuant to section 133 of the Labour Relations Act, 1995, the Board makes the following determinations:
a) that Groupe Multi-Prov Inc. is bound to the Union’s Provincial Collective Agreement;
b) that Groupe Multi-Prov Inc. has violated the said Collective Agreement;
c) Groupe Multi-Prov Inc. shall pay to the Union the sum of $6,000.00 as damages resulting from the violation of the Collective Agreement, such payment to be made within 8 days of execution of this Agreement;
d) upon receipt of payment referred above, the union shall withdraw the grievance.
