DECISION OF THE BOARD; June 20, 2001
This is an application pursuant to section 69 of the Labour Relations Act, 1995 (the “Act”).
The parties have agreed upon a number of issues in this application. However, a comparison of the applicant’s version of the bargaining unit description for service employees with that put forward by the responding party OPSEU leaves the Board at a loss as to whether or not the parties have agreed upon a bargaining unit description and if so, what that description is.
The parties are directed to clarify the appropriate bargaining unit description for the intermingled employees, and kindly advise the Board accordingly in order that the proper description can be incorporated into the Board’s decision under section 69.
The Board does not have jurisdiction to make an order respecting seniority pursuant to section 69.
