DECISION OF THE BOARD; May 24, 2001
1This application was filed on February 27, 2001.
2No responses were filed.
3By letter dated May 3, 2001, the applicant noted that fact and requested that the Board consequently issue the requested declaration as soon as possible.
4By decision dated May 7, 2001, the Board (somewhat differently constituted) indicated that in the absence of any timely objection, the relief requested might issue.
5The time limit set for any such objection has now passed and none has been filed.
6Having regard to the uncontested materials filed by the applicant and to its unopposed request the Board hereby declares that Hydro One Inc.; Hydro One Networks Inc.; Ontario Hydro Energy Inc.; Hydro One Telecom Inc.; Hydro One Network Services Inc.; Hydro One Markets Inc.; and Hydro One Remote Communities Inc. are associated or related businesses or activities under common control or direction within the meaning of section 1(4) of the Labour Relations Act, 1995 and as a result constitute one employer for the purposes of the Act.
7Further, in view of the Board’s decision in Board File No. 2749-99-R, the Board also notes that Ontario Hydro Delivery Services Company Inc. and Ontario Hydro International Inc. have already been found to be related employers within the meaning of the Act.
8Having further regard to the unopposed request of the applicant the Board further declares that those last two named entities and the seven entities listed in paragraph 6 above are all related employers within the meaning of the Act.
