DECISION OF THE BOARD; September 26, 2001
Decision
1The Board has received correspondence from the Employment Practices Branch of the Ministry of Labour with respect to the Board’s decision of August 29, 2001. The Employment Practices Branch asserts that there has been an error in the calculation of monies to be paid out by the Director. If this is the case, it is entirely the fault of the Board; counsel for the Ministry was extremely helpful to the conduct of the hearing and the settlement that was reached.
2It is not clear from the letter if the money held in trust has been paid out. The Board’s orders will have to be amended, but it is not clear how at this point. The Board requests the Employment Practices Branch to advise at its earliest convenience whether it still retains in trust the sum of $1,396.43 or not. Even if the money has not yet been paid out, there is no reason why the applicant should wait until November 15, the next day set for hearing, for the money that can be released.
3Board File No. 0018-01-ES will remain dismissed for the reasons given in the August 29, 2001 decision. I remain seized of this application.
