Decision
1This is an application for certification. The responding party has asked the Board to dismiss the application as it did not receive a form C-1 from the applicant. It appears that the responding party did receive all of the other necessary documents and has posted the Board’s notices as required. The application form used by the applicant does not refer to a form C-1 in the Certificate of Delivery which appears to have contributed to the problem.
2The applicant has now provided the responding party with a form C-1. However, there is no reason why the responding party does not already have the documents it requires to file a response. The Board therefore denies the responding party’s request to dismiss the application. The responding party is expected to file its response in the normal course.
