DECISION OF THE BOARD; October 29, 2001
1These are an application for certification and two applications filed under section 96 of the Labour Relations Act, 1995 (the "Act").
2At the date and time scheduled for hearing, October 25, 2001, the parties met and resolved the matters in dispute between them.
3Having regard to that agreement, the Board directs that a second representation vote be taken of the individuals in the bargaining unit of:
all carpenters and carpenters' apprentices employed by Stanson Drywall Systems Ltd. in the industrial, commercial and institutional sector of the construction industry in the Province of Ontario, save and except non-working foremen and persons above the rank of non-working foreman and all carpenters and carpenters' apprentices employed by Stanson Drywall Systems Ltd. in all sectors of the construction industry in the City of Toronto, the Regional Municipalities of Peel and York, the Towns of Oakville and Halton Hills and that portion of the Town of Milton within the geographic Townships of Esquesing and Trafalgar, and the Towns of Ajax and Pickering in the Regional Municipality of Durham, excluding the industrial, commercial and institutional sector, save and except non-working foremen and persons above the non-working foreman.
The individuals entitled to vote are those identified in "Schedule A" attached.
4The vote will be held on November 9, 2001. Other vote arrangements will be as agreed to by the parties and set out on the attached "Notice of Vote".
5Voters will be asked to indicate whether or not they wish to be represented by the applicant in their employment relations with the responding party.
6The responding party is directed to post copies of this decision and of the "Notice of Vote" where it will most likely come to the attention of the voters listed in Schedule "A". This shall remain posted until the vote is held.
7Board File Numbers 0629-01-U and 1003-01-U are hereby withdrawn with leave of the Board.
8The matter is referred to the Registrar.
