DECISION OF THE BOARD; July 24, 2001
1This matter is an application pursuant to section 74 of the Labour Relations Act, 1995 (the “Act”). The responding party, Ontario Public Service Employees Union (“OPSEU”) has filed a response in which it requests that the application be dismissed on the basis that: the application does not plead facts that, if true, would establish that OPSEU has violated section 74; there are no facts pleaded that, if true, support the applicants’ request for monetary damages; and there is no labour relations purpose to be served by enquiring into the application. This matter was referred to me for the purpose of considering OPSEU’s request.
2Having reviewed the application and the response, it is my determination that it is not appropriate to dismiss this application at this time. This matter is hereby referred to the Registrar for the purpose of scheduling this matter for one day of consultation to take place after September 10, 2001. OPSEU may renew its request at the consultation should it elect to do so.
