Ontario Labour Relations Board
Between: National Automobile, Aerospace, Transportation and General Workers Union of Canada (CAW-Canada), Applicant v. Corporation of the City of Thunder Bay Homes for the Aged, Responding Party v. Service Employees International Union, Local 268, Intervenor.
Before: Laura Trachuk, Vice-Chair, and Board Members J. A. Ronson and D. A. Patterson.
Decision of the Board: May 1, 2001
Decision
This is a displacement application for certification. The intervenor claims that the application is untimely as it is still engaged in the interest arbitration process under the Hospital Labour Disputes Arbitration Act. It has filed a number of documents relating to that claim. The Board considers it appropriate to seek submissions from the applicant with respect to the timeliness issue. The applicant is therefore directed to file submissions with the Board with respect to the issue raised by the intervenor before 5:00 p.m. Wednesday, May 2, 2001. If the responding party wishes to make submissions on this issue it should do so by that time as well. Copies of the submissions should be provided to the other parties. The Board will decide after reviewing the submissions whether to hold a representation vote in this application at this time.
