Decision of the Board: December 12, 2001
Decision
1Since its latest decision in connection with these matters, the Board has received another flurry of correspondence from the parties.
2It appears there is some agreement, although perhaps not consensus, that Friday, December 14, 2001 is not a good day for a vote. We agree. Accordingly, the vote is cancelled.
3Given the number of submissions, the number of issues and the number of ballot configurations possible, the Board has come to the conclusion that it would be beneficial to the parties and, most importantly to the affected employees, to hear what the parties have to say on certain issues.
4Accordingly, a panel of the Board will hold a consultation among the parties to deal with two issues: the form of ballot and the date that the vote should be held. The dates under consideration are December 20 or 21, 2001 or both.
5The consultation will take place Monday, December 17, 2001 at 9:30 a.m. at the Board’s offices, 505 University Avenue, Toronto.
6The consultation will begin by each party having the opportunity to make submissions. Submissions may be no longer than 20 minutes in length. The Board will then ask the parties questions.
7All parties must file with the Board (and serve on the other parties) written submissions by no later than noon on Friday, December 14, 2001. Those submissions must include a statement setting out the parties’ position with respect to the date the vote should be held and the form of ballot. Apart from those two issues there is no need to repeat submissions already made.
