1This is an application for a review of a decision of an employment standards officer pursuant to section 68 of the Employment Standards Act, R.S.O. 1990 ch. E-14 ("the Act"). On July 9, 2001 the Board issued a decision directing the responding party to respond to the allegation made by the applicant that it had failed to comply with Minutes of Settlement executed in this matter. This decision was delivered by courier to the responding party on July 10, 2001. No response has been received from the responding party.
2In light of the responding party's silence, the Board can only conclude that the applicant is correct and that the responding party has not complied with the settlement in this matter. Accordingly, pursuant to section 69.1(8) of the Act, this application for review will be re-commenced. The Registrar is directed to list this application for one day of hearing.
