1This is an application for review of a decision by an Employment Standards Officer not to issue an Order to Pay. The application was not filed in a timely fashion. The representative of the applicant contacted the Board approximately two and half weeks after the application was due and asked that the Board exercise its discretion to extend the time limits. The Board directed the applicant to file the application which has subsequently been received. After reviewing the correspondence filed on behalf of the applicant the Board has decided to exercise its discretion under section 68(4) to extend the time for applying for review. This application is therefore deemed to be timely.
